Nova English Academy
These Terms and Conditions govern the use of this website and the online English lesson
services provided by Nova English Academy. By enrolling in lessons, booking classes, or using
this website, you agree to be bound by these Terms.
1. Service Description
Nova English Academy provides live, online English language lessons to children, teenagers,
and adults worldwide via virtual platforms.
2. Enrolment and Acceptance
- Students must complete the official enrolment form before lessons begin.
- By enrolling, you confirm that all information provided is accurate.
- Lesson access is granted only once payment is received.
3. Fees and Payment (CPA Compliance)
- In accordance with the Consumer Protection Act:
- All prices are displayed clearly before purchase.
- Payment is required in advance for all lessons or lesson packages.
- No hidden fees will be charged.
- Nova English Academy reserves the right to update pricing with prior notice to existing
students.
Failure to pay will result in lessons being paused or cancelled.
4. Cancellations, Rescheduling and “No Shows”
To ensure fairness to teachers and students:
- A minimum of 12 hours’ notice is required to cancel or reschedule a lesson.
- Cancellations made with less than 12 hours’ notice will be forfeited.
- If a student is more than 10 minutes late, the lesson is considered a no show and is not
refundable. - If Nova English Academy cancels a lesson, it will be rescheduled at no cost.
This policy complies with the CPA as it relates to booking time-based professional services.
5. Refund Policy (CPA Section 17 & 19)
- Refunds are not provided for missed lessons or late cancellations.
- Refunds for prepaid packages may be requested in writing and will be considered on a
pro-rata basis, less any administrative costs. - Approved refunds will be processed within a reasonable time frame.
6. Student Responsibilities
Students agree to:
- Arrive on time
- Have a working device, camera, microphone, and stable internet
- Behave respectfully toward teachers and staff
Nova English Academy reserves the right to suspend or terminate lessons for inappropriate
behaviour without refund.
7. Technical Issues
Nova English Academy is not responsible for lesson interruptions caused by:
- Student internet failure
- Power outages (load shedding)
- Device or software malfunction on the student’s side
If the issue is on our side, the lesson will be rescheduled.
8. Teacher Substitution
If a teacher is unavailable, Nova English Academy may assign a qualified substitute teacher to
avoid cancellation.
9. Intellectual Property
All lesson content, materials, videos, worksheets, and resources remain the property of Nova
English Academy and may not be copied, recorded, or distributed.
10. Recording of Lessons
Lessons may be recorded for quality control, training, and safety purposes. These recordings
are private and will never be shared publicly.
11. Protection of Personal Information (POPIA Compliance)
Nova English Academy is committed to protecting your personal information.
By enrolling, you consent to the collection and use of your information for:
- Lesson scheduling
- Communication
- Billing
- Academic tracking
Your information will never be sold or shared with third parties. You may request access to or
deletion of your personal data at any time.
12. Limitation of Liability
Nova English Academy is not liable for
- Indirect or consequential losses
- Academic results or exam outcomes
- Interruptions outside of our control
13. Right to Amend Terms
Nova English Academy reserves the right to update these Terms at any time. Continued use of
services indicates acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
